PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. By using this website, you signify your consent to these terms of use. If you do not agree to these Terms of Use, please do not use the website.

Your access to and use of this website, as well as all related websites operated by LEADERSHIP PASSPORT, LLC, which includes www.leadershippassport.com, among others. collectively the “Site,” is subject to the following terms and conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect:

  1. You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”) are maintained for your personal use and information by LEADERSHIP PASSPORT, LLC, (the “Company”) and are the property of the Company and/or its third-party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of the Company, as well as other authors who created the materials, and may be subject to monetary damages and penalties. You may not distribute, modify, transmit or use the content of the Site or any Content, including any and all software, tools, graphics and/or sound files, for public or commercial purposes without the express written permission of the Company.
  2. All Content, such as text, data, graphics files, videos and sound files, and other materials contained in the Site, are copyrighted unless otherwise noted and are the property of the Company and/or a supplier to the Company. No such materials may be used except as provided in these Terms of Use.
  3. All trade names, trademarks, and images and biographical information of people used in the Company Content and contained in the Site, including without limitation the name and trademark “LEADERSHIP PASSPORT”, are either the property of, or used with permission by, the Company. The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. Any unauthorized use of Content may violate the copyright, trademark, and other proprietary rights of the Company and/ or third parties, as well as the laws of privacy and publicity, and other regulations and statutes. Nothing contained in this Agreement or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any Trademark or other proprietary information without the express written consent of the Company or third-party owner. The Company respects the copyright, trademark and all other intellectual property rights of others. The Company has the right, but has no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use. If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the Site or in any Content in any way, you may notify Company at [email protected]. Please provide your name and contact information, the nature of your work and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other information you believe is relevant.
  4. While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.
  5. When you register with the Company and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company. You consent to receive notices electronically by way of transmitting the notice to you by email.
  6. If you send comments or suggestions about the Site to the Company, including, but not limited to, notes, text, drawings, images, designs or computer programs, such submissions shall become, and shall remain, the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to (including intellectual property rights thereto), and shall be entitled to unrestricted use, publication, and dissemination as to all such submissions for any purpose, commercial or otherwise without any acknowledgment or compensation to you.
  7. The Company shall use commercially reasonable efforts to restrict unauthorized access to Company data and files. However, no system whether or not password protected can be entirely impenetrable. Client/ Attendee/ Participant/ Purchaser acknowledges that it may be possible for an unauthorized third party to access, view, copy, modify, or distribute the data and files Client/ Attendee/ Participant/Purchaser stores using the Site. Use of the Site is completely at Client/ Attendee/ Participant’s own risk.
  8. The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. By using the Site, you signify your acceptance of the Company’s Privacy Policy, www.leadershippassport/privacy-policy. If you do not agree with this Privacy Policy, in whole or part, please do not use this Site.
  9. NEITHER THE COMPANY NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR MAINTAINING THE SITE AND/OR ANY CONTENT ON THE SITE SHALL BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SITE. WITHOUT LIMITING THE FOREGOING, ALL CONTENT ON THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF THE MATERIALS IN THE SITE, THE RESULTS OF THE USE OF SUCH MATERIALS, THE SUITABILITY OF SUCH MATERIALS FOR ANY USER’S NEEDS OR THE LIKELIHOOD THAT THEIR USE WILL MEET ANY USER’S EXPECTATIONS, OR THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR CORRECTION. THE COMPANY LIKEWISE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS OR GUARANTEES THAT YOU WILL EARN ANY MONEY USING THE SITE OR THE COMPANY’S TECHNOLOGY OR SERVICES. YOU ACCEPT ALL RESPONSIBILITY FOR EVALUATING YOUR OWN EARNING POTENTIAL AS WELL AS EXECUTING YOUR OWN BUSINESS AND SERVICES. YOUR EARNING POTENTIAL IS ENTIRELY DEPENDENT ON YOUR OWN PRODUCTS, IDEAS, TECHNIQUES; YOUR EXECUTION OF YOUR BUSINESS PLAN; THE TIME YOU DEVOTE TO THE PROGRAM, IDEAS AND TECHNIQUES OFFERED AND UTILIZED; AS WELL AS YOUR FINANCES, YOUR KNOWLEDGE AND YOUR SKILL. SINCE THESE FACTORS DIFFER AMONG ALL INDIVIDUALS, THE COMPANY CANNOT AND DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS OR GUARANTEES REGARDING YOUR SUCCESS OR INCOME LEVEL. THE COMPANY DOES NOT WARRANT THAT USE OF THE MATERIALS WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE, THE CONTENT, AND/OR THE MATERIALS AVAILABLE ON THIS SITE ARE FREE FROM BUGS OR VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RESPONSIBILITY FOR THE COST OF ALL NECESSARY REPAIRS OR CORRECTIONS. THE COMPANY SHALL NOT BE RESPONSIBLE FOR ANY PERFORMANCE OR SERVICE PROBLEMS CAUSED BY ANY THIRD-PARTY WEBSITE OR THIRD-PARTY SERVICE PROVIDER. ANY SUCH PROBLEM SHALL BE GOVERNED SOLELY BY THE AGREEMENT BETWEEN YOU AND THAT PROVIDER. Please note that the applicable jurisdiction may not allow the exclusion of implied warranties. Some of the above exclusions may thus not apply to you.
  10. THE COMPANY SHALL NOT BE RESPONSIBLE FOR ANY PERFORMANCE OR SERVICE PROBLEMS CAUSED BY ANY THIRD-PARTY WEBSITE OR THIRD-PARTY SERVICE PROVIDER (including, for example, your web service provider service, Stripe, PayPal or other payment services, your software and/or any updates or upgrades to that software). ANY SUCH PROBLEM SHALL BE GOVERNED SOLELY BY THE AGREEMENT BETWEEN YOU AND THAT PROVIDER. THE COMPANY RESERVES THE RIGHT TO DETERMINE, IN ITS SOLE DISCRETION, WHETHER THE COMPANY IS RESPONSIBLE FOR ANY SUCH MALFUNCTION OR DISRUPTION. THE COMPANY ALSO RESERVES THE RIGHT TO LIMIT YOUR USE OF THE SITE AND/OR THE CONTENT OR TO TERMINATE YOUR ACCOUNT SHOULD THE COMPANY DETERMINE THAT YOU HAVE VIOLATED THESE TERMS OF USE, OR THAT YOU HAVE VIOLATED ANY OTHER RULES OR CONDITIONS OF THE COMPANY. THE COMPANY RESERVES THE RIGHT TO REFUSE ACCESS TO THE SITE AND/OR THE COMPANY’S CONTENT, PRODUCTS AND/OR SERVICES TO ANYONE IN ITS SOLE DISCRETION. THE COMPANY RESERVES THE RIGHT TO DETERMINE, IN ITS SOLE DISCRETION, WHETHER THE COMPANY IS RESPONSIBLE FOR ANY SUCH MALFUNCTION OR DISRUPTION. THE COMPANY MAY, IN ITS SOLE DISCRETION, REFUND THE INITIAL FEE CHARGED FOR ANY USE OF THE SITE AND/OR ANY CONTENT OR A PRO-RATA PORTION THEREOF CONSISTENT WITH THE COMPANY’S REFUND POLICY. THE COMPANY SHALL REFUSE ANY REFUND THIRTY (30) DAYS AFTER YOUR PAYMENT FOR USE OF THE SITE AND/OR ANY CONTENT, EITHER PURSUANT TO THE COMPANY’S CUSTOMER LICENSE AGREEMENT OR OTHERWISE, REGARDLESS OF THE REASON FOR DISRUPTION.
  11. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS, OCCASIONED BY ANY DEFECT IN THE SITE, THE CONTENT, AND/OR RELATED MATERIALS, THE INABILITY TO USE SERVICES PROVIDED HEREUNDER OR ANY OTHER CAUSE WHATSOEVER WITH RESPECT THERETO, REGARDLESS OF THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF THE COMPANY HAS BEEN ADVISED OR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.
  12. You agree to indemnify and hold the Company and each of its directors, officers employees, and agents, harmless from any and all liabilities, claims, damages and expenses, including reasonable attorney’s fees, arising out of or relating to (i) your breach of this Agreement, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services that the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users of the Site or the services. The Company reserves the right to assume the exclusive defense of any claim for which Company is entitled to indemnification under this Section. In such event, you shall provide the Company with such cooperation as is reasonably requested by the Company.
  13. The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates and its third-party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.
  14. This agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Orange County, California. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
  15. These Terms of Use may be revised from time to time by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms of Use to which you are bound.

TERMS of USE – Seminars, Programs and Products

TERMS, DISCLAIMERS, AND CONDITIONS REGARDING PROGRAMS, SEMINARS, AND PRODUCTS

The followings are the terms and conditions relating to Client/ Attendee/ Participant’s usage, participation, and/or attendance at the Leadership Passport seminars, products, and programs.— These services may include training (via live, telephone, virtual, or online), seminars (live, virtual, or online), teleseminars, and webinars (hereafter referred to in the singular tense as "Seminar"),  consulting and coaching programs via live, telephone, online or virtual (hereafter referred to in the singular tense as "Program"),  and written, digital, electronic and recorded products (hereafter referred to in the singular tense as "Product"), which are produced by Leadership Passport, LLC ("Promoter"). These terms and conditions are relevant to all Leadership Passport, LLC Seminar, Program, and Product. By registering for and/or participating in any of the Promoter's Program, purchasing or utilizing any of the Promoter's Product, or registering for and/or attending or participating in any of the Seminar at any of the locations ("Venue"), you (the "Client/ Attendee/ Participant") indicate your acceptance of, agreement with, and obligation to these Terms and Conditions. If you have objections to the following Terms and Conditions, you should not register, purchase, utilize, attend, or participate in the Seminar, Program, or Product.

Client/ Attendee/ Participant Conduct
Promoter requires all Clients/ Attendees/ Participants to be courteous to the staff, hosts, speakers, and other Clients/ Attendees/ Participants and their guests or families throughout the Seminar or Program, including between scheduled events and during breaks. At the sole discretion of the Promoter’s staff, representative(s), or agents(s), the Promoter reserves the right to ask Client/ Attendee/ Participant and/or their guests to leave the meeting room and Venue immediately and/or cease their participation in the Seminar or Program should they be deemed discourteous, uncooperative, unprofessional, a potential threat to the safety of others, intoxicated or in possession of alcohol, drugs or any illegal substance. In such case, the Client/ Attendee/ Participant’s tuition/fees for the Seminar, Program and/or Product will not be reimbursed under any circumstances, and they will not receive any future products, services, or correspondence from Promoter. Client/ Attendee/ Participant will also not receive any advertised bonuses or qualify for any written or implied satisfaction guarantees.

Liability Waiver

Client/ Attendee/ Participant is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements:

I, the willing Attendee of the Seminar and/or Client/ Participant in the Program and/or Product, hereby accept all risks to my health and of my injury or death that may result from participating in the Seminar/Program/Product, and I hereby release Promoter, Leadership Passport, and their officers, employees, interns, contractors, partners, sponsors, agents, and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Seminar, Program, or Product, whether caused by the negligence of the Promoter, its governing board, officers, employees, agents, partners, or representatives, or otherwise. I further agree to indemnify and hold harmless the Promoter, Leadership Passport, and any third-party company from liability for the injury or death of any person(s) and property damage that may result from my negligent or intentional act or omission while attending and participating in the Seminar/ Program/Product. Under no circumstances will Promoter, Leadership Passport, or their assigns be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Seminar/Program/ Product. Should I require emergency medical treatment due to an accident or illness arising during my attendance and participation in the Seminar/Program/ Product, I consent to such treatment. I acknowledge and agree to be financially responsible for any medical or legal bills that may be incurred due to emergency medical treatment. I will notify Promoter verbally and in writing if I am at any time injured before, during, or after the Seminar/Program in my travels or attendance or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Promoter is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Seminar/Program/ Product, I will notify the Promoter, and the Promoter retains the right to ask that I not participate in portions of or the entirety of the Seminar/ Program/ Product.

 

 Liability Disclaimers

The information contained in or made available by the Promoter, Leadership Passport, or any third party through the Seminar/Program/ Product or their websites or services is solely information for use at Client/ Attendee/ Participant's discretion. The information cannot replace or substitute for the Client/ Attendee/ Participant's knowledge and expertise they have gained from personal experience and education along with additional advice or expertise gained from other trained professionals in any field, including, but not limited to, professional, business mental, financial, medical, psychological, or legal areas. Promoter does not make or execute any decisions for the Client/ Attendee/ Participant, and none of the information contained in the Seminar/ Program/ Product should be confused as such guidance. 

Promoter collaborates with other organizations and partners, who may speak, train or provide other services during the Seminar/ Program/ Product. Under no circumstances, including but not limited to negligence, will Promoter, Janice McLaughlin George, nor their assigns, sponsors, suppliers, licensors, partners, speakers, contractors, or any of their affiliates will be liable, direct or indirect, consequential, special, exemplary, for any loss or damage sustained or alleged to have been caused to a Client/ Attendee/ Participant or the Client/ Attendee/Participant's business, including economic loss, that may result from participation in the Seminar/ Program/ Product or from the use of, or the inability to use, the materials, information, or strategies communicated through the Seminar/ Program/ Product or any products or services provided pursuant to the Seminar/ Program/ Product, even if advised of the possibility of such damages. Client/ Attendee/ Participant, alone, is responsible and accountable for decisions, actions, and results. By Client/ Attendee/Participant's engagement in the Seminar/ Program/ Product, Client/ Attendee/ Participant acknowledges such and agrees not to attempt to hold the Promoter, Janice McLaughlin George, staff, agents, partners, or representatives liable for any decisions, actions, or results that Client/ Attendee/ Participant makes or experiences personally or professionally, physically or financially, in business or life, due to Client/ Attendee/ Participant's engagement in the Seminar/ Program/ Product at any time, under any circumstance.

As stipulated by law, Promoter cannot guarantee the Client/ Attendee/Participant's ability to get results or earn any money with Promoter's ideas, information, tools, or strategies. Client/ Attendee/ Participant should know that all products and services by Promoter are for educational and informational purposes only. Nothing on this page, any of Promoter websites, content, or curriculum is a promise or guarantee of results or future earnings. Any financial numbers referenced here, or on any of Promoter sites, are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance. Making decisions based on any information presented in Promoter's Seminar/ Program/ Product or website is solely at the risk of the Client/ Attendee/ Participant. Client/ Attendee/ Participant alone is responsible and accountable for decisions, actions, and results in business or life, personally or professionally. By Client/ Attendee/Participant's registration and engagement, Client/ Attendee/ Participant agrees not to attempt to hold Promoter liable for Client/ Attendee/Participant's decisions, actions, or results, at any time, under any circumstance. 

The information, services, products, claims, seminar topics, and materials on Promoter's Sites are provided "as is" and without warranties, either expressed or implied. Promoter disclaims all warranties, expressed or implied, including but not limited to the implied effectiveness of the ideas or success strategies listed on this Site and those provided in Promoter's Seminar/ Program/ Product to Client/Attendee/ Participant. The only exceptions are explicitly labeled guarantees within the Sites. Neither Promoter nor its respective licensors or suppliers warrant that any functions provided via the Sites will be uninterrupted or error-free, that defects will be corrected, or that the Sites or the server that makes them available are free of viruses or other harmful components. Neither Promoter nor any of its respective licensors or suppliers warrant or make any representations regarding the use or the results of the use of the services, products, information, or materials on this Site regarding their correctness, accuracy, reliability, or otherwise. Client/ Attendee/ Participant  (and not Promoter or any of its respective licensors or suppliers) assumes the entire cost of all necessary servicing, repair, or correction to Client/ Attendee/ Participant’s system. 

Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to Client/ Attendee/ Participant. Promoter does not endorse, warrant or guarantee any speakers, products, or services offered on the Sites or those Promoter links to. Promoter is not a party to and does not monitor any transaction between users and third-party providers of products or services. Under no circumstances, including but not limited to negligence, will Promoter or any of its licensors or suppliers be liable for any special or consequential damages resulting from utilizing the materials or information on the Sites or from the inability to access the products and services offered by the Sites, even if such damages are known to Client/ Attendee/ Participant. 

Promoter or any of its partners, licensors, or suppliers shall not be liable to any Client/ Attendee/ Participant for any damages, losses, or causes of action (whether in contract, tort, or otherwise) exceeding the amount paid by the Client/ Attendee/ Participant to Promoter for accessing the Sites. 

Promoter is also not responsible or liable for any loss or damage caused or alleged to have been caused to its guest speakers due to displaying their photo, name, or biography on Promoter's Sites or in Promoter's marketing materials.

Confidentiality and Non-Compete

Promoter respects Client/ Attendee/ Participant’s confidential and proprietary information, ideas, plans, copyrights, patents, trademarks, trade secrets, and intellectual property rights (collectively, "Intellectual Property"). Promoter must insist that Client/ Attendee/ Participant respect the same rights of fellow Seminar/ Program participants, Janice McLaughlin George, and the Promoter. By participating, Client/ Attendee/ Participant agree not to infringe on the Intellectual Property rights of any Seminar/ Program participant, Janice McLaughlin George, or the Promoter. Therefore Client/ Attendee/ Participant hereby understand and agree that the Intellectual Property, along with the tools, techniques, processes, formulas, strategies, concepts, materials, content, design, and information (hereafter referred to as "Intellectual Property and Confidential Information") presented in the Seminar/ Program/ Product are confidential, copyrighted, and/or proprietary to the Promoter and/or Janice McLaughlin George and that any Intellectual Property and Confidential Information shared by Seminar/ Program/ Products participants or any representative of the Promoter is confidential and proprietary, and belongs solely and exclusively to the Promoter or the Client/ Attendee/ Participant who discloses it. Therefore, Client/ Attendee/ Participant hereby agree not to record, duplicate, distribute, teach, or train the Seminar/ Program/ Product Intellectual Property and Confidential Information in any manner whatsoever without the express written permission of the Promoter and/or Janice McLaughlin George. Client/ Attendee/ Participant agrees to treat all Intellectual Property and Confidential Information as valuable, special, and unique assets of the Promoter and/or Janice McLaughlin George. Client/ Attendee/ Participant will protect the Intellectual Property and Confidential Information and treat it as strictly confidential. Client/ Attendee/ Participant agree to not directly or indirectly engage in any competitive business with the Promoter and/or Janice McLaughlin George in the geographic territory of North America, South America, Europe, Asia, or South Africa. Directly or indirectly engaging in any competitive business includes, but is not limited to engaging in business as an owner, partner, agent, or employee, having a direct or indirect interest in any such business, or soliciting any customer of Promoter for the benefit of the Client/ Attendee/ Participant or a third party engaged in such business. Client/ Attendee/ Participant further agrees that this non-compete provision will not adversely affect Client/ Attendee/ Participant 's livelihood.

Additionally, any unauthorized use or distribution of the Seminar/ Program/ Product Intellectual Property and Confidential Information by Client/ Attendee/ Participant or Client/ Attendee/ Participant’s representatives is prohibited, and Promoter will pursue legal action and full damages if these terms are violated to protect its rights. Client/ Attendee/ Participant hereby understand and agree that a violation of this paragraph will be a material violation of the Terms and Conditions of this Agreement and will justify legal and/or equitable relief. Client/ Attendee/ Participant hereby agree that if Client/ Attendee/ Participant violate, or display any likelihood of violating, any of Client/ Attendee/ Participant’s agreements contained in this paragraph, the Promoter will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations. While Client/ Attendee/ Participant are free to discuss personal results from the Promoter's Seminar/ Program/ Product, Client/ Attendee/ Participant must keep the experiences and statements, oral or written, of the Promoter, Janice McLaughlin George, agents, partners, representatives, and all participants in the strictest of confidence.

Adult Content

Promoter discourages adult or profane language from the platform; however, Promoter is not responsible for the communications of participants, Venue staff, Clients/ Attendees/ Participants, and guests. Client/ Attendee/ Participant uncomfortable with such content should not attend the Seminar/ Program/ Product.

Spiritual Content

Promoter, Clients/ Attendees/ Participants may respectfully and courteously discuss spiritual topics relating to personal and professional growth during the Seminar/ Program or in the Product if applicable to the training discussion points. The Seminar/ Program/ Products provide a forum for sharing ideas and beliefs, and each individual can contribute positively to the group regardless of their personal beliefs, even if they differ from the personal beliefs of others. Client/ Attendee/ Participant uncomfortable with such topics should not attend or participate in the Seminar/ Program/ Product.

Political Content

Promoter, Clients/ Attendees/ Participants may respectfully and courteously discuss political topics relating to global business, social justice, or personal and professional growth in the Seminar/ Program or the Product. Promoter considers Seminar/ Program and Product a forum for ideas and believe that each individual can contribute positively to the group regardless of their personal beliefs, even if they differ from the personal beliefs of others in the group. Participants who are uncomfortable with such topics should not attend or participate in the Seminar/ Program/ Products.

 Personally Objectionable Content

Client/ Attendee/ Participant agree that Promoter has no liability for any content Client/ Attendee/ Participant find objectionable, including but not limited to Adult, Spiritual, or Political topics.

Audio/Visual Rules and Release

Clients/ Attendees/ Participants may not use any recording device to capture the information provided at the Seminar/ Program/ Products. No audio recording, photography, videography, or screenshots are allowed in the seminar room or are to be used to capture information provided in Program/Product. By participating in the Seminar/ Program/ Product, Client/ Attendee/ Participant understands that portions of the Seminar/ Program may be recorded in video and audio and/or captured in still and/or digital photographs by the Promoter. Client/ Attendee/ Participant agrees the Promoter and its assigns have the right and permission to use such recordings and photographs should they include Client/ Attendee/ Participant's name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising, or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Client/ Attendee/ Participant. Client/ Attendee/ Participant understands and agrees that all recordings from the Promoter's events are the exclusive rights of the Promoter, and Client/ Attendee/ Participant does not ask for or expect compensation for the use of recordings or photographs in which Client/ Attendee/ Participant appears or speaks. Promoter owns all rights to any audio, video, and/or photograph captured during the Promoter's Seminar/ Program/ Product or at any of the Promoter's other live, virtual, online events. 

Seminar/ Program Privacy Policy and Terms of Use

Client/ Attendee/ Participant acknowledges and agrees that they are subject to the Privacy Policies and Terms of Use of the Promoter provided at http://www.leadershippassport.com.

Cancellation Policy for Seminars and Programs
Promoter allows for cancellation and the transfer of Seminar tickets, Program passes, and Raincheck Vouchers within given timeframes as noted in this policy. 

Promoter has a 100% refund policy for any Seminar/ Program canceled within ten (10) days of registration for a Seminar/ Program scheduled more than ten (10) days away. Once Client/ Attendee/ Participant registers for a Seminar/ Program, Promoter makes extensive arrangements and investments and incurs administrative expenses and loss of business in the case of cancellation. Therefore, Promoter only accepts cancellations within ten (10) days of the Client/ Attendee/ Participant's registration for a Seminar/ Program scheduled more than ten (10) days away. If Client/ Attendee/ Participant registers within ten (10) days of the event, Client/ Attendee/ Participant understands that this refund policy is not guaranteed.  

Clients/ Attendees/ Participants who cancel within ten (10) days of registering for a Seminar/ Program over ten (10) days away are protected by the 100% refund policy and will receive a full refund. Any Client/ Attendee/ Participant seeking to cancel their registration after ten (10) days will not under any circumstances receive a refund but instead may receive a ticket or pass to a future Promoter's Seminar / Program on the same or similar topic or may transfer the ticket(s) or pass(es) to another party. If a prospective Client/ Attendee/ Participant is unsure of attendance at the Seminar/ Program, please do not register.

If, for whatever reason, Client/ Attendee/ Participant is unable to attend the Seminar/ Program and cancels within ten (10) days of the Seminar/ Program scheduled for more than ten (10) days out, Promoter will happily refund Client/ Attendee/ Participant’s money, transfer ticket(s) or pass(es) to someone else, or allow Client/ Attendee/ Participant 's attendance to a Seminar/ Program on a similar topic at Promoter's sole discretion.

If Client/ Attendee/ Participant has registered and cannot attend a Seminar/ Program, please email [email protected] at least five (5) business days before the event to qualify for Raincheck Vouchers and transfers. If notified at least five (5) business days in advance, Promoter will happily transfer the ticket(s) or pass(es) to a friend, family member, or business associate or provide Client/ Attendee/ Participant with a Raincheck Voucher, which entitles Client/ Attendee/ Participant to attend a future Seminar or Program similar to the one Client/ Attendee/ Participant is unable to participate in (excluding travel expenses). 

 Digital Content Availability, Downloading, and Risk of Loss of Digital Content/ All Sales Final/ License and Restrictions

Once Purchaser have purchased Digital Content, Promoter encourages Purchaser to download it promptly and make backup copies. If Purchaser needs help to complete a download after reviewing online help resources, Purchaser should contact Promoter customer service. Client/ Attendee/ Participant bear all risk of loss after purchase and for any loss of Digital Content Client/ Attendee/ Participant have downloaded, including any loss due to a computer or hard drive crash. All sales of Digital Content are final. Promoter does not accept returns of Digital Content. 

  1. Upon Client/ Attendee/ Participant’s payment of fees for Digital Content, Promoter grants Purchaser a non-exclusive, non-transferable license to use the Digital Content for solely personal, non-commercial, non-entertainment use, subject to and in accordance with the terms of this Agreement. Purchaser may copy, store, transfer, and burn the Digital Content only for personal, non-commercial, non-entertainment use. 
  1. Purchaser represents, warrants, and agrees that Purchaser will use the Service only for personal, non-commercial, non-entertainment use and not for any redistribution of the Digital Content or other restricted use. Purchaser agrees not to infringe the rights of the Digital Content's copyright owner (Promoter and/or Janice McLaughlin George) and to comply with all applicable laws regarding the use of the Digital Content. Purchaser agrees that Purchaser will not redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, sub-license, or otherwise transfer the use of the Digital Content. Purchaser is not granted any synchronization, public performance, promotional use, commercial sale, resale, reproduction, or distribution rights for the Digital Content. Purchaser acknowledges that the Digital Content embodies the intellectual property of Promoter and/or Janice McLaughlin George and is protected by law.  

Review and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Virginia, in the county of Loudoun. Client/ Attendee/ Participant agrees that any dispute that arises out of or relates to these Terms will be resolved via non-binding mediation in the State of Virginia, in the county of Loudoun via a professional mediator obtained by the Promoter and if a successful mediation is not reached, to binding arbitration arbitrated in the State of Virginia, in the county of Loudoun, in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of Use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining Terms of Use and will not affect the validity and enforceability of the remaining provisions.

Shipping Policies and Rates

Orders will be shipped within five (5) business days. The number of delivery days quoted for Shipping Methods is from the Date of Shipment, not the Date of Order Placement. This process also relates to all expedited orders; however, expedited orders are given top priority, and every effort is made to ensure expedited orders are shipped within two (2) business days. For international orders, please allow two (2) to four (4) weeks for delivery due to customs. Please read about customs policies.

Calculating Shipping Costs

Shipping costs for orders from Promoter depend upon the method Purchaser chooses and the shipping destination. Please also note that the shipping rates for many items Promoter sells are weight-based. Promoter will reflect the shipping company's policies; therefore, all weights will be rounded up to the next full pound.

Shipping Costs Calculation

Promoter charges a single flat fee for each shipment, plus additional, smaller fees for each item in that shipment. The total shipping charge will be displayed on the last page of the order form before Purchaser places the order.

Items Shipment

Promoter reserves the right to choose an appropriate shipping carrier for Purchaser’s shipment but generally uses the United States Postal Service, FedEx, UPS, or other applicable couriers. Purchaser does not have the option to specify a preferred carrier when placing the order. When the Purchaser selects One-Day or Two-Day Shipping, Promoter may use air or ground shipping to get items to Purchaser within the promised timeframe, depending upon location.

Copyright Complaints

Promoter respects the intellectual property rights of others. If a Party believes there may be a copyright infringement on the website, please follow the Notice and Procedure for Making Claims of Copyright Infringement. Please also provide the written information specified below. Please note that this procedure is exclusively for notifying Promoter of a potential copyrighted material infringement.

  1. An electronic or physical signature of the Party authorized to act on behalf of the owner of the copyright interest;
  2. A description of the copyrighted work claimed to have been infringed;
  3. A description of where the material that Party claims is infringing is located on the Website;
  4. Party's address, telephone number, and e-mail address;
  5. A statement by Party regarding a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement by Party, under penalty of perjury, that the foregoing information in Party's notice is accurate and that Party is the copyright owner or authorized to act on the copyright owner's behalf.

 Forums

A "forum" means any message board, chat room, user review forum, or interactive service appearing on any of the Sites and includes public and private folders.

Party must register in accordance with instructions that Party will find on the Sites in order to contribute to any forum. Party may not post on any forum or send to any other forum user or Promoter's staff any material that is abusive, vulgar, threatening, harassing, libelous, defamatory, obscene, invades a person's privacy, violates any intellectual or other property rights or that would otherwise violate any law.

Party may not use any forum in a commercial manner. Party may not post material that solicits funds or that advertises or solicits goods or services. Party may not post material known to be false. Party may not post or transmit any information, software, or other material that contains a virus or other harmful component. Promoter is not responsible for material appearing in any forum on the Sites.

Promoter is not responsible for screening material users post for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or other reasons. Promoter retains, however, the right to modify or remove messages or other material that Promoter, in sole discretion, considers infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. Promoter also reserves the right to edit materials for any other reason. Whether or not Promoter modifies or removes such material, users remain solely responsible for the content of their messages or postings. By posting on the Sites, Party grants (or warrants that the owner of such rights has expressly granted) Promoter and/or relevant affiliated companies the worldwide, perpetual, nonexclusive right to use Party's questions, comments, and postings, in their original or edited form, in television programs, books, articles, commentaries, or in any other medium now known or later developed. Party also warrants that it owns or otherwise controls all of the rights to the content Party has posted and that the public posting and use of such content by Promoter will not infringe the rights of any third party. Additionally, Party warrants that any "moral rights" in posted materials have been waived. Party is not entitled to compensation for any materials Party may post on the Sites.

Registration

Promoter may, at its discretion, suspend or terminate the registration of any forum user or general user who violates any of these Terms of Use, any of the forum member guidelines, or for any other behavior that Promoter, in its discretion, believes is inappropriate. 

 Parental Permission

The Sites are not directed to persons under the age of 18, and Promoter will not knowingly collect personally identifiable information from persons under 18. At its discretion, Promoter may require users under 18 to obtain the consent of a parent or guardian to view certain content. Promoter may limit access to certain content to users at a specified age. Client/ Attendee/ Participant agrees to abide by any such restrictions and not to help anyone avoid these restrictions.
